1. Information About Us
In accordance with Portuguese consumer and data protection laws, we provide the following legal information:

2. Description of the Service
AdventureScooters offers a shared mobility service consisting of daily scooter rentals within a defined area. The fleet may include different types of scooters (hereafter referred to as “Vehicles”).
The service is provided through our website (hereafter referred to as “Platform”), accessible via smartphone, tablet, or computer browser.

3. Terms of Use
3.1. These Terms & Conditions regulate the relationship between AdventureScooters and all renters (hereafter referred to as “Renter”) who use this scooter rental service.
3.2. By booking a vehicle and ticking the checkbox “I accept the Terms & Conditions and Privacy Policy”, you acknowledge that you have read and understood the terms and agree to comply with them fully.
3.3. This is a personal contract. The renter must always be the person using the service and the only driver of the vehicle.
3.4. The contract language is English.
3.5. Modifications: AdventureScooters may update these Terms to comply with new regulations, technology, or operational needs. Users will be notified in advance. Continued use of the service implies acceptance of the updated Terms. If you do not agree, you must stop using the service.

4. Eligibility Requirements
To rent a vehicle, the Renter must:
– Be at least 18 years old
– Hold a valid driving license for the vehicle category
– Provide a valid ID
– Not use provisional, restricted, lost, or stolen licenses

5. Booking Procedure
5.1. The Renter must book the scooter by submitting a booking request in the Platform  , providing accurate and up-to-date information, including:
Valid driving license
Accepted payment method
5.2. Upon submitting the booking request, the Renter is acknowledging the acceptance of these Terms and the Privacy Policy.
5.3. As part of the booking process, the Renter is required to sign a legally binding agreement (hereafter referred to as the “Rental Service Agreement”) which sets forth the terms and conditions governing the rental service. This agreement shall be executed by both Parties through a secure Digital Signature Service that provides a verifiable audit trail.
5.5. AdventureScooters reserves the right to cancel the reservation if the provided documents are invalid or if the User is not legally allowed to operate a 125cc vehicle in Portugal.
5.6. AdventureScooters may deny registration or suspend service in cases of non-compliance, suspected fraud, identity theft, or unpaid balances.

6. Payment & Invoicing
6.1. Rental prices are clearly displayed during the booking process.
6.2. Promotional offers and discounts may be available.
6.3. Prices are available and updated regularly on the Platform.
6.4. Accepted payment methods include PayPal and credit card.
6.5. By entering your card details, you authorize charges for rental and any related costs.
6.6. If AdventureScooters is charged transaction fees by its payment provider, these may be passed on to the Renter.

7. User Responsibilities
7.1. You must use the service responsibly and comply with all traffic laws and parking rules.
7.2. Specifically, you must:
– Have a valid license throughout the rental period
– Notify us of any license suspension, loss, or theft
– Park the vehicle legally and upload a photo as proof
– Avoid misuse or negligent handling of the vehicle
– Fully cooperate in case of accident or incident
– Not allow others to use the reserved vehicle
– Keep your personal and payment details up to date

8. Insurance, Theft & Damage
8.1. All rentals include mandatory third-party liability insurance. Full details of the insurance provider and coverage are available upon request.
8.2. The insurance cost is included in the rental price.
8.3. If the vehicle is damaged during your rental due to misuse or negligence, you will be charged for the repair costs according to standard pricing. If gross negligence or intentional damage is determined, you will be liable for the full repair value without deductible.
8.4. In case of theft or vandalism, the Renter must:
– Contact us immediately via WhatsApp or email
– File a police report
– Send us a copy of the report within 24 hours
– If the vehicle is stolen or abandoned due to your actions or failure to lock and secure it properly, the Renterwill be held financially responsible.

9. Accidents, Breakdowns & Liability
9.1. In the event of an accident (with or without third parties) or breakdown, the Renter must:
Inform AdventureScooters immediately
Submit an accident report within 48 hours
9.2. If the Renter is found legally at fault, the Renter will be responsible for damages to the vehicle according to the insurance coverage and any applicable deductibles.
9.3. If the Renter fails to report an incident or submit necessary documentation, the Renter may be charged the full cost of damages and suspended from the service.

10. Fines & Penalties
10.1. If the Renter doesn’t return the scooter a 25€ fee may be charged.
10.2. If the Renter doesn’t return the scooter on the agreed return date and time a 15€ fee may be charged.
10.3. If the Renter doesn’t return the scooter on the agreed return date a 50€ may be charged.
10.4. The Renter is fully responsible for complying with traffic, parking, and road use regulations.
10.5. All fines or penalties issued during the rental — or after, if the vehicle was left improperly — will be charged to the Renter, along with any administrative costs incurred by AdventureScooters in processing them.
10.6. If the vehicle is towed or removed due to illegal or unsafe parking (including temporary restrictions), the renter will be responsible for all fees, fines, and penalties.

11. Limitation of Liability
11.1. AdventureScooters is not liable for any indirect or consequential damages unless caused by gross negligence.
11.2. AdventureScooters is not responsible for service interruptions caused by force majeure events such as natural disasters, strikes, technical issues, or administrative restrictions.
11.3. Renters agree to hold AdventureScooters harmless from damages unless proven to result from our gross negligence.

12. Cancellation & Termination
12.1. The Renter may cancel the Booking without any costs up until five (5) days before the Rental Start Date (also designated as “Pickup Date”).
12.2. If the Renter cancels the Booking within the period of four (4) days to forty-eight (48) hours prior the Rental Start Date, a cancellation fee of twenty-five percent (25%) of the Total Rental Cost is charged. 
12.3. If the Renter cancels the Booking within less than forty-eight (48) hours prior the Rental Start Date, a cancellation fee of fifty percent (50%) of the Total Rental Cost is charged. 
12.4. Cancellations made less than twenty-four (24) hours prior to the Rental Start Date are not permitted, and no refund will be issued. 
12.5. No refund will be issued in case the Renter fails to collect the scooter on the Rental Start Date (“No-Show”).
12.6. If the Renter violate these Terms, AdventureScooters may terminate the Rental Service Agreement before the Rental Finish Date (also designated as “Delivery Date”)
12.7. Serious violations may lead to immediate termination, including but not limited to:
– Being underage or without a valid license
– Failing to notify us of license suspension or loss
– Submitting false documents
– Repeated no-shows
– Not paying for damages or fines
– Parking in restricted or unsafe areas
– Reckless driving or vandalism
– Driving under the influence
– Allowing third-party use
– Tampering with or misusing the Platform
